VerifEye helps online platforms confirm that you are a real human and—where required by law or by the platform’s own policy—that you meet a minimum age threshold (for example, 18 years old). The service is operated by Realeyes OÜ, registry code 11730664, with registered office at Vahe 15, 11615 Tallinn, Estonia (“Realeyes,” “we,” “us,” or “our”).
By using VerifEye, you agree to these Terms and Conditions (“Agreement”). If you do not agree, please do not use the service. You can contact us at info@realeyes.ai for questions, accessibility requests, or a copy of this Agreement in another format or language.
1. Purpose of This Service
1.1 VerifEye is an AI-powered tool that analyses brief visual input—such as a short selfie video or camera frame— to estimate your probable age, verify your uniqueness and identity, confirm that you are a real person (not a bot or synthetic image), and enable future account authentication through facial recognition,).
1.2 VerifEye does not decide whether you may access any content or service.
That decision is always made by the Business Customer (for example, the website or app you are trying to enter) based on the Verification Result provided by VerifEye.
1.3 VerifEye does not store your identity documents and does not issue legal proof of age. It provides a technical estimation used solely for compliance with age-assurance or human-verification requirements.
1.4 You may use VerifEye only for lawful purposes and in accordance with this Agreement, our Privacy Policy [hyperlink], and any local laws that apply to you.
2. Definitions
For clarity, capitalized terms have the meanings below:
- Agreement – these Terms and Conditions for Users, together with any policies linked or incorporated by reference.
- Business Customer – the third-party website, platform, or application that uses VerifEye to check whether users meet a required age or authenticity threshold.
- End User / You – the natural person who uses VerifEye to verify their age or humanness in order to access content or services from a Business Customer.
- End User Data – any personal data you submit through VerifEye (such as a facial image or camera frames) that is processed to generate a Verification Result.
- Personal Data – any information relating to an identified or identifiable individual as defined by the GDPR, UK GDPR, CCPA/CPRA, or other applicable laws.
- Service / VerifEye Service – the technical solution provided by Realeyes that uses AI to estimate whether you are a human and whether you appear to be over a specified age threshold.
- Third-Party Provider – an external vendor contracted by Realeyes to supply part of the Service (e.g., cloud hosting, liveness analysis, fraud detection) under strict data-protection agreements.
- Verification Result – the binary or categorical outcome of the process (e.g., “18 or over,” “under 18,” “human verified,” or “unable to estimate”) that is shared with the Business Customer
- We / Us / Our – Realeyes OÜ, the operator of VerifEye and Data Processor acting on behalf of Business Customers.
3. SCOPE OF THE AGREEMENT
3.1 By using VerifEye, you authorize [CP1] Realeyes and its Third-Party Providers to process your End User Data for the purpose of estimating your probable age and authenticity status.
3.2 Your participation is voluntary. If you choose not to complete the process, you may not be able to access the Business Customer’s content or service that requires verification.
3.3 Realeyes acts only as a technical intermediary and Data Processor. We do not control how the Business Customer uses the Verification Result or what access decision they make.
3.4 To the maximum extent permitted by law, Realeyes and its Third-Party Providers are not liable for any consequence of a Business Customer’s access decision or for inaccurate information you submit.
3.5 If you become aware that incorrect or unauthorized[CP2] data has been submitted through VerifEye, please notify us immediately at info@realeyes.ai so that we can take appropriate action (including deletion or correction in accordance with applicable law).
4. Other Applicable Policies
4.1 The following policies form an integral part of this Agreement and apply to your use of VerifEye:
- Privacy Policy – explains how we collect, use, share, and protect your Personal Data and your rights under the GDPR, UK GDPR, CCPA/CPRA, and other laws.
- Cookies Policy – describes our use of cookies or similar technologies where applicable.
4.2 By continuing to use VerifEye, you acknowledge that you have read and understood those policies and that your data will be processed as described therein.
5. Access & Use of the Service
5.1 Eligibility. VerifEye may be used by individuals of any age when required by a Business Customer to confirm that a user is above or below a specific age threshold. You must, however, satisfy the legal requirements of your country for using online verification services. If you are at or above the age of majority in your jurisdiction, you may use VerifEye on your own behalf. If you are below that age or below the digital-consent age established by local law, the consent of a parent or legal guardian must be obtained before you begin the verification process. By proceeding with VerifEye, you confirm that you meet the applicable age requirement or that appropriate parental or guardian consent has been provided.
5.2 Cost. VerifEye is free for End Users; you will not be charged any fee to complete a verification session.
5.3 Technical Requirements. To use VerifEye properly, you need a camera-enabled device, a modern browser, and a stable internet connection. You will also need to grant temporary camera permission for the process to work.
5.4 Service Availability. We may suspend VerifEye temporarily for maintenance, security, or legal reasons. Where possible, we will provide prior notice via the Business Customer or our website. Such interruptions are not considered a breach of this Agreement.
5.5 User Responsibility. You are responsible for ensuring that the device you use is safe and secure. You must not use VerifEye on behalf of another person or submit any altered, synthetic, or fraudulent image data.
6. Data Processing & Privacy
6.1 Roles of the Parties.
When you use VerifEye, Realeyes processes your Personal Data as a Data Processor on behalf of the Business Customer, which acts as the Data Controller. The Business Customer determines why and how your data is processed (for example, to confirm you meet an age requirement). Realeyes carries out only the technical analysis and returns the Verification Result to the Business Customer.
6.2 Purpose of Processing.
Your data is processed exclusively to:
- verify that you are a real human (liveness check);
- estimate your probable age to confirm whether you meet the threshold defined by the Business Customer;
- verify your uniqueness to determine whether you have already participated in a certain activity, transaction, or service, or maintain another account;
- enable secure account authentication by creating and storing a facial embedding for future identity verification;
- prevent fraud or automated (bot) submissions; and
- ensure security, auditing, and compliance with legal obligations.
6.3 Types of Data Processed.
Depending on how the Business Customer has integrated VerifEye, the Service may temporarily process:
- Short video or camera frames showing your face (used only for real-time estimation and immediately deleted thereafter);
- Derived numeric data (e.g., model embeddings used for algorithmic processing);
- Technical metadata (device type, session ID, browser information); and
- Verification Result (e.g., “18 or over,” “under 18,” or “human verified”).
No identity documents, financial data, government IDs or images of individuals are collected by VerifEye.
6.4 Data Minimization[CP3] and Retention.
Raw visual data is automatically deleted promptly after inference, typically within minutes, after the verification process completes. Anonymized or pseudonymized[CP4] technical data may be retained for a limited period only for security, fraud-prevention, or audit purposes, consistent with our Privacy Policy.
6.5 Third[CP5] -Party Providers.
To deliver the Service, Realeyes uses trusted Third-Party Providers that supply cloud hosting, system security, or AI components. These providers are bound by contractual obligations ensuring data protection equivalent to those set out in the GDPR and UK GDPR. Examples include:
- Cloud infrastructure (e.g., AWS EU/UK regions);
- Content delivery networks for latency optimization[CP6] ; and
- Analytics and monitoring tools for system performance and security.
Where data is transferred outside your jurisdiction, we use valid transfer tools (e.g., EU SCCs/UK Addendum, or adequacy decisions) and supplementary measures.
6.6 Independent Processing for AI Improvement.
In limited cases, Realeyes may process anonymized or pseudonymized data as an independent Data Controller for the purpose of improving and maintaining the accuracy, security, and fairness of its artificial intelligence[CP7] models. This may include developing new algorithms, detecting fraudulent or automated patterns, and generating aggregated, non-identifiable statistics. Such processing is carried out on the basis of Realeyes’ legitimate interests in ensuring the reliability and safety of its technology and is always consistent with our Privacy Policy (hyperlink). Where this processing involves pseudonymized[CP8] Personal Data, you have the right to object at any time on grounds relating to your particular situation, in accordance with Article 21 GDPR. Realeyes does not use this data to make individual decisions about you or to produce profiles that affect you personally[CP9] .
6.7 Transparency and Consent.
Before you start the process, VerifEye (or the Business Customer’s interface) will display a notice explaining what data is needed, how it is used, and your rights. Where required by law (for example, when biometric data is involved), you will be asked for explicit consent before continuing. If you do not give consent, the verification cannot proceed.
We do not sell or share your Personal Data as those terms are defined under the CCPA/CPRA.
6.8 Security Measures.
Realeyes applies strict technical and organizational[CP10] measures, including encryption, secure transmission (TLS 1.2 or higher), multi-factor access controls, and regular penetration testing. While no online system is fully risk-free, these measures are designed to prevent unauthorized access, loss, or misuse of your data.
6.9 Your Rights.
You have the right to access, correct, delete, or restrict processing of your Personal Data, as well as the right to lodge a complaint with a data-protection authority. Requests can be sent to verifeye@realeyes.ai
7. User Representations & Obligations
7.1 Accuracy and Authenticity.
You confirm that all data you provide through VerifEye is genuine, accurate, and lawfully obtained. You must not use altered, filtered, or computer-generated images or attempt to impersonate another person.
7.2 Lawful Use.
You agree to use VerifEye only for the purpose of verifying your age or human status as requested by a Business Customer, and in compliance with applicable laws. You may not use the Service in any way that could harm Realeyes, its infrastructure, or other users.
7.3 No Misuse.
You agree not to:
(a) bypass or interfere with any security feature of VerifEye;
(b) attempt to access systems or data without authorization[CP11] ;
(c) upload or submit any malicious code or harmful software;
(d) copy, modify, or reverse-engineer any part of the platform;
(e) use VerifEye for testing, benchmarking, or research without written permission; or
(f) use VerifEye to make or train your own AI systems.
7.4 Device Responsibility.
You are responsible for maintaining the security of your device and ensuring no third party uses it to complete the verification on your behalf.
8. Confidentiality & Security of Information
8.1 Confidential Handling of Data.
All End User Data processed by VerifEye and its Third-Party Providers is treated as confidential and is subject to contractual and legal safeguards under data-protection laws.
8.2 Limited Disclosure.
Realeyes may disclose information only:
(a) to the relevant Business Customer (limited to the Verification Result);
(b) to authorized service providers bound by confidentiality; or
(c) where required by law, court order, or competent authority.
Any such disclosure will be limited to the minimum necessary.
9. Termination & Suspension
9.1 Your Right to Stop Using the Service.
You may stop using VerifEye at any time. Once you discontinue the process, your Agreement with Realeyes ends automatically. Stopping use does not affect the legality of data processing already completed under your consent.
9.2 Suspension or Termination by Realeyes.
Realeyes may suspend or terminate your access immediately if:
(a) you breach these Terms;
(b) you submit false or fraudulent data;
(c) your use poses a legal, security, or regulatory risk; or
(d) suspension is required by law or competent authority.
Where feasible, we will inform you or the relevant Business Customer before taking such action.
9.3 Effects of Termination.
After termination, Realeyes will delete or anonymize[CP12] your data in accordance with its retention policy and legal obligations. You will no longer be able to access the verification record or outcome through the platform.
10. Indemnification & Limitation of Liability
10.1 Your Indemnity.
You agree to indemnify and hold harmless Realeyes, its affiliates, officers, employees, and service providers from any loss, damage, or expense (including reasonable legal fees) arising out of:
(a) your breach of this Agreement or applicable law;
(b) submission of false, fraudulent, or unlawful information to the Service; or
(c) misuse of VerifEye or interference with its operation.
10.2 Service Disclaimer.
VerifEye provides a technical estimation only and does not constitute legal proof of age or identity. Realeyes does not guarantee that a Business Customer will grant you access based on the Verification Result or that the Service will be error-free, uninterrupted, or compatible with all devices and browsers.
10.3 Limitation of Liability.
To the maximum extent permitted by law, Realeyes shall not be liable for any indirect, incidental, special, or consequential loss (including loss of data, reputation, or access opportunity). Realeyes’ total aggregate liability to you under this Agreement shall not exceed EUR 100 (or the equivalent in local currency). Nothing in this clause limits liability for fraud or willful misconduct where such limitation is prohibited by law. Nothing excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
10.4 Third-Party Websites.
Any content, service, or decision provided by a Business Customer is entirely that party’s responsibility. Realeyes has no control over and does not endorse such third-party content or policies.
11. Intellectual Property
11.1 All rights, title, and interest in and to VerifEye (including software, algorithms, AI models, design, and documentation) belong exclusively to Realeyes or its licensors.
11.2 Nothing in this Agreement grants you any license or ownership over VerifEye or its outputs. You may use the Service only as expressly permitted under these Terms.
11.3 You must not copy, modify, translate, reverse engineer, or create derivative works from any part of VerifEye or remove any copyright or trademark notices.
11.4 “VerifEye” and associated marks are trademarks of Realeyes OÜ. You may not use our logos or branding without written consent.
12. Modification of the Terms
12.1 Realeyes may revise these Terms from time to time to reflect changes in law, technology, or service features.
12.2 If the changes materially affect your rights or obligations, Realeyes will make reasonable efforts to notify you (for example via a notice on the verification page).
12.3 The updated Terms take effect once posted. Your continued use of VerifEye after that date constitutes acceptance of the revised version.
13. Dispute Resolution & Governing Law
13.1 This Agreement is governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-law rules.
13.2 Unless mandatory consumer-protection laws require otherwise, any dispute arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of London, United Kingdom.
13.3 If you are considered a consumer under the laws of your residence and those laws mandate that local courts have jurisdiction, that provision shall prevail.
13.4 Before initiating formal proceedings, we encourage you to contact us and seek an amicable resolution.
14. General Provisions
14.1 Force Majeure. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control (e.g., natural disasters, internet outages, government actions).
14.2 Severability. If any provision of this Agreement is found invalid or unenforceable, it shall be modified to the minimum extent necessary to remain valid; the rest of the Terms remain in effect.
14.3 No Waiver. A failure to exercise any right under these Terms does not constitute a waiver of that right.
14.4 Entire Agreement. These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and Realeyes concerning VerifEye and supersede any prior statements or understandings.
14.5 Assignment. You may not assign your rights or obligations under this Agreement. Realeyes may assign its rights to an affiliate or successor that assumes the same obligations, subject to notice.
14.6 Language. These Terms are drawn up in English. If translated, the English version prevails in case of inconsistency.
